How Long Do You Have To Submit Your Appeal?
Video Transcribed: I am the paralegal with the Oklahoma Unemployment Experts and I assist Mr. Lawson, the attorney. How are you guys doing?
So I want to talk to you guys about the unemployment appeal process. Unfortunately, we had a hearing set for one of our clients and he did not get his appeal in and we are still waiting from the Appeal Board on that decision. So what happened was, let’s, let’s take it back a little bit. He was terminated due damage of property and a bunch of other little stuff.
Well, our client has been working there for 20 plus years and never had a bad report, never been written up, nothing. And we actually have one of the witnesses going to be at the hearing stating that that’s not true because he was with him on the day that they’re saying that he damaged some property, which was, remind you, let me tell you, it’s just a toilet paper holder.
That’s it. Our client, but offered to pay for a new one. So yeah. Okay. So let’s fast forward a little bit. So our client came in for the hearing and the appeal board says, well he didn’t file his appeal on time so there’ll be no hearing. Our client thought it was 10 days with him receiving the letter.
I cannot express how important it is to know this information. It is 10 days, the day they mailed it. You know that little stamp. Here’s an example, this little stamp. Okay, it has date on there. You see, let’s see this one says May 21st, okay. It would be 10 days on this date to file an appeal. Not 10 days I got it, 10 days they mailed it.
I cannot express what this means now for our client, we’re going to appeal that decision and we’ll get an answer back within seven to 14 business days and hopefully we’ll have a chance to get a new hearing. It’s up in the air. We will not know and I’ll definitely keep you guys updated on that case cause it’s very important to me. I care deeply for our clients and I care that they get their benefits.
So I just want you guys to understand it’s 10 days. All you have to do to file it is go to your Oklahoma Unemployment access. It’ll say claimant access at the very bottom. You click that and then after that it’ll take you to your social, your pin. You hit continue, and then you go to your, it says like filing an appeal.
You click that, it’ll ask you some questions. You must submit that 10 days of the mailing date. because then it gives them basically enough time for the hearing and etc. It just, it’s a bunch of craziness in it, but the most important thing out of this video wants you to do to get, it’s 10 days on the mailing date because now we don’t know what’s going to happen for our client and that I just know it freaks me out. I like things in order, so please remember that.
