Oklahoma Unemployment Expert secures benefits for deserved client.
Video Transcribed: I’m with the Oklahoma Unemployment Experts and I got something in the mail today. Here we go. So I want to talk to you a little bit about this case. This one’s actually pretty interesting to me.
Our client was working for a school and he was security, and for our client liked to get breakfast and lunch on campus at a restaurant. They had other options there. Remind you, it was 5 or 10 minutes, he’d be gone to get something to eat and he’d be back at his post.
Well, our client had been in this for the past five to six years, I believe, and nothing was ever said to him. Nothing seemed to be a problem. So when our client went to work one day, he was called into his boss’s office and he was terminated due to him leaving his post.
Remind you, he stated that he always told his boss, his manager, whoever he needed to tell that, “Hey, I want to run down at one of these restaurants and grab something to eat.” Remind you, it’s on campus so he’s not leaving. He’s just not away from his, he’s just away from his post about 5 to 10 minutes. Again, with everyone aware that he was gone.
Well our client went to work one day and his manager called him into his office and our client was terminated. Well, our client decided to file an appeal. He went to his Oklahoma unemployment, claimed an access, filed an appeal, called us and said, “Hey, I need your help. I have appeal hearing coming up. I don’t know what to do.” So we got on board with client and we had a hearing on this.
The employer’s issue was stating that he left his post. He’s not allowed to leave his post, point blank. He’s always supposed to be there, but at the same time they get lunch breaks and bathroom breaks, whatever they need to do that’s appropriate. So when our client was asked if he left his post, technically he did leave his post, but the manager and boss was aware because he was only gone 5 or 10 minutes, but he never left campus.
That was our issue. And the employer kept saying, “Well, he was leaving, he was leaving.” That’s what they kept telling the the appeal judge. And we’re just like, “Well, again, our argument is he never left campus.” So I’m really hoping our client got benefits. He was a great guy. He just, I say all of our clients deserve it and that’s 100% true, but this process was very stressful to him. You could tell with his health and everyone’s got bills to pay. So I really hope our client got benefits. So let’s open it up and see what we got.
Whoo! And he got his benefits. That is so exciting. So again, a little summary. He was terminated for leaving his post and leaving campus, but in all reality, he never left campus. He always stayed on campus just to grab something to eat, gone five to 10 minutes and was terminated. And we got our client has benefits. So I’m super excited.
